1. Acceptance of Terms
By accessing or using JointGift ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service. We may update these terms at any time, and your continued use constitutes acceptance of any changes.
2. Description of Service
JointGift is a group gifting platform that allows users to create gift pools, invite others to contribute, and facilitate the purchase and delivery of gifts. The Service is currently in early access and features may change.
3. User Accounts
To use certain features, you must create an account. You are responsible for: • Providing accurate and complete information • Maintaining the security of your password • All activities that occur under your account • Notifying us immediately of any unauthorized access You must be at least 18 years old to create an account.
4. Gift Pools
When creating or contributing to a gift pool: • Pool organizers are responsible for ensuring the intended recipient's consent and accuracy of gift information • Contributions are final once confirmed unless the pool fails to reach its goal • JointGift takes a small service fee (displayed before purchase) to cover platform costs • We reserve the right to cancel pools that violate our policies
5. Payments and Refunds
All payments are processed through our secure payment provider. Refunds are issued if: • A gift pool does not reach its funding goal by the deadline • The gift cannot be delivered as described • We are unable to process the purchase for any reason Refunds are processed within 5-10 business days to the original payment method.
6. Prohibited Conduct
You agree not to: • Use the Service for any unlawful purpose • Create fraudulent gift pools or misrepresent information • Harass, abuse, or harm other users • Attempt to gain unauthorized access to any part of the Service • Use automated tools to scrape or interact with the Service • Violate any applicable laws or regulations
7. Intellectual Property
All content on JointGift, including logos, design, text, and code, is owned by JointGift, Inc. and protected by copyright and trademark laws. You may not use our intellectual property without express written permission.
8. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, JointGift shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Governing Law
These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
